An MSA is necessary when all issues are agreed upon, and you wish to avoid a court hearing. Additionally, you will receive a useful brochure written by attorneys and published for CALDA, California Association of Legal Document Assistants, which provides detailed information regarding the forms required, and an overview of the divorce process. There are three main phases to the process. The first is getting started; providing generic information regarding the parties and any children (name, address, telephone, etc.). The second is the disclosure phase; required by the court in every dissolution, including the identification of assets and debts, and income and expenses. The third is the Judgment; this may include a Marital Settlement Agreement, if there are children, community property/debt, or other agreements to be put into writing.
