QUALIFIED DOMESTIC RELATION ORDER (QDRO) $300 Obtaining an order for a portion of your or your spouse's Retirement Plan in the divorce Judgment is only the first step. Now you need to separate the funds into your account from the Plan. This is done through a Qualified Domestic Relations Order (QDRO). A QDRO is a court order directing the administrator of an employee's Retirement or Pension Plan to separate the funds in a Plan for the benefit of the former spouse, as specified in the divorce judgment. Each Plan, both government or private, may have their own guidelines and policies required for the QDRO, and most will provide the guidelines in writing upon request. Some Plans allow the former spouse to elect a cash payment, others do not allow payment until the employee retires. However, each Plan will need the same basic information to begin.
